WINE MODERNE TERMS OF USE

LEGAL REQUIREMENTS

We as the seller will arrange shipment of wine, as a complimentary service provided, acting on the behalf of the purchaser. If you wish to ship to another state, you assume all responsibility for shipment and complying with local tax requirements and/or regulations. The purchaser assumes ownership of the wines once the order has been processed. We will do our best to enable precautions to ensure your order arrives safely, but Wine Moderne does not accept liability for any issues pertaining to loss or damage (physical or weather related) due to the shipping carrier.

You must be 21 years or older to order alcohol via our online store.

A signature is required from a person of at least 21 years of age to receive shipped items containing alcohol. By placing your order, you have represented to Wine Moderne that you are at least 21. Wines purchased from Wine Moderne are not for resale, and are for personal consumption only.

CREDIT CARD CHARGES

Orders can be paid with credit card, pay pal or by money order or check, however payment needs to be received before an order can be released for shipment. We accept all major credit cards.

MINIMUM PURCHASE

No minimum purchase is required.

ORDERING

Wine Moderne order forms request data from users including: Contact information such as name and shipping address; financial information such as credit card number, expiration date, billing address, and billing phone number. This information is used for billing purposes to verify that the customer is of legal age, and to fill customers’ orders.

If we encounter difficulty when processing an order, this contact information is used to contact the user. This information is harvested from a secure area and encrypted for our customers’ protection. It is not sold or shared with anyone else under any circumstances.

SHARING

We will not sell, share, or rent this information to others in any way that varies from what is disclosed in this statement.

Wine Moderne will share aggregated demographic information with its partners and advertisers. This is not linked to any personally identifiable that can identify any individual person.

We may also share your physical address with carefully selected business partners. These businesses may use the information we share to mail you valuable opportunities and offers. You can opt out of future postal mailings from our business partners by sending an email to info@winemoderne.com.

We use an outside shipping company to ship orders, and a credit card processing company to bill users for goods and services. These companies do not retain, share, store or use personally identifiable information for any secondary purposes.

We value your privacy at Wine Moderne, and will never release any account information to anyone outside of the necessary core groups that help our business function unless our customers give us the authority to do so.

LEGAL DISCLAIMER

TYPOGRAPHICAL ERROR

In the event that a Wine Moderne product is mistakenly listed at an incorrect price, Wine Moderne reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. Wine Moderne reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged.

If your credit card has already been charged for the purchase and your order is cancelled, Wine Moderne shall issue a credit to your credit card account in the amount of the incorrect price.

FORCE MAJEURE

Wine Moderne shall be excused from performance under this Terms of Service if Wine Moderne is prevented, forbidden or delayed from performing, or omits to perform, any act or requirement under this Terms of Service by reason of: (a) any provision of any present or future law or regulation or order of the United States of America, or any state thereof, (b) any act or omission of a third party, or (c) any act of God, emergency condition, war, computer or telecommunications failure or other circumstance beyond the control of Wine Moderne.

This includes any/all vendors, vintners, wineries, persons attending/ participating in/at our events, working behind the table, tasting in front of the table, etc. Your Wine Moderne purchase is for an educational or entertainment experience.

Events to have access to your information provided during registration. You must acknowledge that wine is a drug and will affect your performance of any machinery or vehicle. You must agree not to drive if you are over the legal limit for alcohol consumption or if you do not feel safe to drive.You must agree to keep your consumption in line with socially acceptable behavior and limit your portions to one tasting of each wine. In addition, you take responsibility for your actions prior to, during, and following consumption of alcohol. You will not hold Wine Moderne, partners, businesses, or associates of any licensed establishment, liable for your actions.You accept responsibility for your own actions to the wine being served. This serves as a legal posting, warning and request to protect you from yourself. A taxi can be called for you from any event. Thank you for understanding our concern and genuine interest for your protection and the protection of others.

RIGHT TO USE LIKENESS/PHOTOGRAPHY

Photographs are often taken at our events and we reserve the right to use the pictures taken at our events for promotional purposes. Your picture may be taken, used, posted, and integrated into our Wine Moderne database. “All rights reserved, materials may not be copied or duplicated without the expressed permission of winemoderne.com. All trademarks and copyrights strictly enforced.”

TERMINATION OF YOUR WINE MODERNE ACCOUNT

Wine Moderne may terminate your Wine Moderne Account with or without cause at any time effective immediately.
